Plaintiffs Lindsey LaBella, Michael Pawson and Stacey Rodgers allege that the AirPods Pro suffer from a persistent audio problem, with the units experiencing crackling, static, loss of bass and even excessive noise. The plaintiffs accuse Apple of false advertising despite the sound problems.

The three plaintiffs add that the problem began to appear shortly after the 1st generation AirPods Pro launched and that the company was fully aware of the defects, with many customers reporting audible problems while walking or exercising.

Apple noticed this defect in 2020 and launched a recall programme. However, according to the plaintiffs, this programme was not very clearly announced and some consumers remained unaware of this option. On the other hand, it was also stated that this situation could not be completely resolved because the replaced units still had problems.

The lawsuit filed by customers is pending in the Northern District Court of California and seeks compensation for all affected consumers, as well as reimbursement of attorneys’ fees and legal costs.

If class action certification is granted, US consumers who purchased the 1st generation AirPods Pro model will be able to join the lawsuit and seek compensation for the reported issues.
